THE SNOW EMERGENCY PLAN
FOR THE CITY OF RED OAK, IOWA

RED OAK CITY ORDINANCE CHAPTER 68.11
SNOW AND ICE CONTROL PROGRAM

    1.  Snow Emergency Route(s).  The City Council shall designate snow emergency route(s) in the City of Red Oak, and shall cause signs to be posted designating the route(s) as a snow emergency route.  A snow emergency shall be declared by the Mayor by proclamation, and the Mayor shall direct the Police Chief to inform all available news media in the area to publicize the proclamation and the parking rules thereunder.
    2.  Formulation of Snow and Ice Control Program.  It is the duty of the Street Superintendent and the Police Chief, to formulate a snow and ice control program, which program shall be presented to and approved by the City Council by resolution.
    3. Snow Emergencies.  In the event of a snow emergency, no person shall park, abandon or leave unattended any vehicle on any public street, alley, or City-owned off-street parking area during any snow emergency unless the snow has been removed or plowed from said street, alley or parking area and the snow has ceased to fall (italics, mine).  During such emergency, parking shall specifically be prohibited on East-West streets and Circle streets between the hours of seven o-clock (7:00) A.M. and twelve o-clock (12:00) noon and on North-South streets between the hours of one o-clock (1:00) P.M. and six o-clock P.M. except that parking shall be allowed after cleaning operation have been completed.
    4.  Authority to Impound Vehicles.  Members of the police department are authorized to remove or have removed a vehicle from a street, alley, highway or City-owned off-street parking area, to the nearest garage or other place of safety, or to a garage designated or maintained by the police department or otherwise maintained by the City, when such vehicle is left parked in violation of the ban on parking during a snow emergency, duly proclaimed by the Mayor.
    5.  Violation and Penalty.  A violation of this section shall be a misdemeanor and shall be punishable as provided in this Code or Ordinances, and in addition thereto, the owner or driver, or either of them, of any vehicle impounded for a violation of the ban against parking during a snow emergency shall be required to pay the reasonable cost of towing and storage charges.
    6.  Construction.  This section shall not be construed as suspending parking limitations or restrictions imposed by any other section of this Code of Ordinances.

***Section 5 of the Ordinance discussed the cost of towing and storage charges.  The City of Red Oak is not contracted with any towing service.  Therefore, as independent operators, they may charge the fees they deem necessary.  The City of Red Oak charges $10.00 per day for storage.  All fines, towing and storage fees must be paid in full before the release of the vehicle.
